Dynamic Braking Ordinance Hearing Delayed

Pierre, SD –The proposed dynamic braking ordinance originally scheduled to be heard by the Pierre City Commission for the second time on Tuesday, Sept. 27, has been removed from the agenda.

Since its first reading on Tuesday, Sept. 13, the commission has received a considerable amount of constituent feedback both in favor of and against the proposed ordinance. In light of the feedback, the commission is delaying the second reading of the ordinance to allow its membership more time to examine the issue.

A copy of Ordinance 1773, the proposed dynamic braking ordinance is below.

That Section 9-2-149 be and is hereby amended to add the following: D. Dynamic Braking or Air-Braking Devices 1. Defined. Dynamic braking device (Commonly referred to as Jacobs Brakes) means a device used primarily on trucks for the conversion of the engine from an internal combustion engine to an air compressor for the purpose of braking without the use of wheel brakes. 2. Prohibited. Operating any motor vehicle with a dynamic braking device engaged except for the aversion of imminent danger shall be prohibited within the territorial jurisdiction of the City. 3. Public emergency response vehicle exception. Any public emergency response vehicle equipped with a dynamic braking devise will be allowed to use such devise during a response to an emergency situation.
